FLONIFY Terms & Conditions

Welcome to FLONIFY's Canadian website and mobile platform.

These Terms and Conditions ("Agreement" or "Terms") govern your use of the https://flonify.com/ website (the "Site"), related FLONIFY mobile application(s) available to Canadian residents (the "App(s)"), any written, electronic, or oral communications with FLONIFY, and any features or content operated by us (collectively, the "Services").

To use the Services, you must be the age of majority in your province or territory.

BY ACCESSING OR USING THE SERVICES, YOU AGREE TO THESE TERMS. IF YOU DO NOT AGREE, PLEASE DO NOT USE THE SERVICES.

1. GENERAL

1.1 Ownership

The Site and Apps are owned and operated by FLONIFY Canada Inc. and licensed by FLONIFY Global Holdings.In Canada, all transactions are processed by FLONIFY Canada Inc.

The Services are designed for Canadian users. If you order products for shipment outside of Canada, you may be redirected to the appropriate local website and subject to that region’s terms.

1.2 Updates to the Terms

We reserve the right to update or modify these Terms at any time. Continued use of the Services after such changes constitutes acceptance of the revised Terms.

1.3 Policies Incorporated by Reference

The following policies are incorporated into these Terms:

  • Privacy Policy
  • Bonus Points Policy
  • Coupon Policy
  • Gift Card Policy

Additional terms may apply for contests, promotions, or specific features.

2. USE OF OUR SERVICES

2.1 License to Use the Services

FLONIFY grants you a limited, revocable, non-transferable, and non-exclusive license to access and use the Services solely for personal, non-commercial shopping purposes.

Any violation of this Agreement results in immediate revocation of this license without notice.

2.2 Prohibited Uses

You may not:

  • Reproduce, distribute, sell, or exploit any part of the Services without permission.
  • Use automated bots, scrapers, or similar technology to access or manipulate the Services.
  • Upload malicious software (e.g., viruses, worms, Trojan horses).
  • Engage in fraudulent activity, including multiple fake accounts, unauthorized plug-ins, or using false claims to obtain refunds.
  • Interfere with other users’ experience or violate any applicable laws.

2.3 Account Creation & Termination

To access certain features, you must create an account ("User Account"). You are responsible for:

  • Keeping your login credentials confidential
  • All activity under your account
  • Reporting unauthorized use immediately

FLONIFY reserves the right to suspend or terminate accounts that violate the Terms or applicable laws.

2.4 Digital Wallet ("Wallet")

Your FLONIFY Wallet stores:

  • Bonus Points (earned through purchases and promotions)
  • Coupons (subject to expiration & policy rules)
  • Wallet Credit (store credits from returns)
  • Gift Cards (purchased or received as promotions)

Your Wallet balance cannot exceed $2,000 CAD and has no cash value, except as required by law.

2.5 Accurate Information

You must provide true and complete details when making purchases. FLONIFY is not responsible for order delays or cancellations due to incorrect information.

3. PRIVACY POLICY

Your use of the Services is subject to FLONIFY's Privacy Policy, which outlines how we collect, store, and use your data.

4. ERRORS

While we strive for accuracy, errors in pricing, descriptions, and availability may occur. We reserve the right to correct any mistakes and modify orders accordingly.

5. PURCHASES

5.1 Pricing & Orders

Prices exclude shipping & applicable taxes (sales tax, provincial tax, etc.). All transactions are processed in Canadian Dollars (CAD).

5.2 Color Accuracy

We make reasonable efforts to accurately display product colors, but variations may occur due to screen differences.

5.3 Shipping & Title Transfer

Ownership of purchased items transfers to you upon delivery to your provided shipping address.

5.4 Returns & Refunds

  • You can return products within 45 days of purchase.
  • First return on an order is free; subsequent returns may have fees.
  • Refunds can be issued as Wallet Credit or original payment method.

Non-returnable items:

  • Bodysuits, lingerie, swimwear, jewelry, and certain accessories.

6. INTELLECTUAL PROPERTY

6.1 Content Ownership

All text, graphics, software, and other content on the Services are owned by or licensed to FLONIFY and protected under intellectual property laws.

6.2 Trademarks

All FLONIFY logos, marks, and branding are property of FLONIFY Global Holdings and MoversTrade Inc.

6.3 User-Generated Content (UGC)

By posting content on the Services, you grant FLONIFY a worldwide, royalty-free, irrevocable license to use, modify, and distribute your content.

UGC must not contain:

  • Hate speech, harassment, or illegal content
  • Copyright violations
  • False or misleading claims

7. THIRD-PARTY LINKS & RESOURCES

FLONIFY may provide links to third-party sites but is not responsible for their content or policies.

8. TEXT MESSAGING PROGRAM

  • You may opt-in to receive FLONIFY promotional messages.
  • Standard text message rates apply.
  • You may opt-out at any time by replying STOP.

9. EVENTS BEYOND OUR CONTROL ("Force Majeure")

FLONIFY is not liable for delays caused by:

  • Natural disasters (earthquakes, floods, pandemics)
  • Labor strikes or supply chain disruptions
  • Government restrictions
  • New tax implications 

10. LIMITATION OF LIABILITY

FLONIFY’s liability is limited to the amount you paid for the purchased product.

We are not liable for:

  • Indirect, incidental, or consequential damages
  • Loss of business, profits, or data
  • Third-party service failures

11. DISPUTE RESOLUTION & ARBITRATION

11.1 Initial Dispute Resolution

We encourage users to contact FLONIFY Customer Support to resolve disputes before legal action.

11.2 Arbitration Agreement

Except where prohibited, disputes shall be resolved through binding arbitration instead of court.

11.3 Class Action Waiver

To the extent allowed by law, you waive the right to participate in class action lawsuits against FLONIFY.

11.4 Small Claims Court Exception

You may file eligible claims in small claims court instead of arbitration.

11.5 30-Day Opt-Out Right

You may opt out of arbitration by sending written notice within 30 days of agreeing to these Terms.

12. ADDITIONAL LEGAL TERMS

12.1 Indemnification

You agree to indemnify FLONIFY for any legal claims arising from:

  • Your use of the Services
  • Your violation of these Terms
  • Third-party claims related to your content

12.2 Governing Law

These Terms are governed by Canadian laws and, where applicable, the laws of your province.
