FLONIFY Intellectual Property Infringement Appeal Guidelines

Scope
These guidelines apply to intellectual property (IP) infringement appeals on the FLONIFY Marketplace platform. Sellers may submit appeals for the following types of IP infringement claims:
- Copyrights
- Trademarks
- Industrial Designs
- Patents
Each type of IP infringement has a specific appeal process and required documentation, as outlined below.
1. Copyright Infringement Appeals
Appeal Process
- Submit a Counter-Notice under the Digital Millennium Copyright Act (DMCA).
- Provide the required documentation (listed below).
- The appeal will be reviewed by the FLONIFY IP Protection Team.
- A final decision will be communicated to the appellant within 21 business days.
Required Materials
- Your physical or electronic signature.
- Identification of the removed or disabled material and the original location before removal.
- Contact information (full name, mailing address, phone number, and email).
- A statement under penalty of perjury affirming that the material was wrongfully removed or disabled due to a mistake or misidentification.
- A statement of consent to the jurisdiction of the Federal District Court (or, for non-U.S. residents, any judicial district where FLONIFY operates).
Important Notes
- The removed material may be restored 10–14 business days after the counter-notice is processed unless the original claimant files a lawsuit.
- False counter-claims may result in legal liability, including fines and attorney fees.
- FLONIFY reserves the right to reject appeals made in bad faith.
2. Trademark Infringement Appeals
Appeal Process
- Submit a Trademark Infringement Appeal Form.
- Provide required documentation (listed below).
- The appeal will be reviewed by the FLONIFY IP Protection Team.
- A decision will be communicated within 7 business days.
Required Materials
- A completed Trademark Infringement Appeal Form.
- Proof of trademark registration or valid authorization to use the trademark.
- A detailed explanation of why the infringement claim is invalid.
- Any supporting evidence (e.g., non-infringement evidence).
3. Industrial Design Infringement Appeals
Appeal Process
- Submit an Industrial Design Infringement Appeal Form.
- Provide required documentation (listed below).
- The appeal will be reviewed by the FLONIFY IP Protection Team.
- A final decision will be communicated within 7 business days.
Required Materials
- A completed Industrial Design Infringement Appeal Form.
- Proof of industrial design registration or valid authorization to use the design.
- A detailed explanation of why the infringement claim is invalid.
- Any supporting evidence (e.g., prior art, non-infringement documentation).
4. Patent Infringement Appeals
Appeal Process
- Submit a Patent Infringement Appeal Form.
- Provide required documentation (listed below).
- The appeal will be reviewed by the FLONIFY IP Protection Team.
- A decision will be communicated within 21 business days.
Required Materials
- A completed Patent Infringement Appeal Form.
- Proof of patent registration or valid authorization to use the patent.
- A detailed explanation of why the infringement claim is invalid.
- Any supporting evidence (e.g., prior art, non-infringement evidence).

How to Report an Intellectual Property (IP) Issue on FLONIFY

If you believe that your intellectual property (IP) rights have been infringed on the FLONIFY Marketplace, you can report the issue by following these steps. Providing accurate and complete information will help us efficiently review and address your complaint.
1. Access the FLONIFY IP Notice Section
- Scroll to the bottom of the FLONIFY homepage and click on IP NOTICE.
2. Open the Complaint Portal
- On the Intellectual Property Notice page, locate and click the FLONIFY IP Complaint Portal:
www.flonify.com/ip-complaint.
3. Review Required Materials
- Carefully read the list of materials required for filing an IP complaint. Once reviewed, click BEGIN.
4. Identify Your Relationship to the Rights Holder
- Select your relationship to the rights holder (e.g., owner, legal representative, or agent). Click CONFIRM.
5. Choose the Patent Type & Infringement Scenario
- Select the type of intellectual property issue you are reporting. Based on your selection, additional infringement scenario options will be provided.
- Choose the appropriate scenario and click NEXT.
6. Provide Detailed Information
Submit comprehensive details based on the type of IP issue you are reporting:
Trademark Issue
- URL or SKU number(s) of the infringing product(s)
- Trademark name or description
- Trademark application or registration number (Optional)
- Date of first trademark use
- Supporting evidence (links or files showing use of the trademark)
Copyright Issue
- Description of the copyrighted work
- URL or SKU number(s) of the infringing product(s)
- Copyright Registration Number (if applicable)
- Date of first publication (when the work was made publicly available)
- Supporting evidence (links or files showing the copyrighted work)
- Proof of original work creation
Utility Patent Issue
- Description of the utility patent
- URL or SKU number(s) of the infringing product(s)
- Patent Registration Number
- Country of patent registration
- Supporting documents (links or files showing the registration)
- Court order or judgment supporting your claim
Design Rights Issue
- URL or SKU number(s) of the infringing product(s)
- Design Registration Number (if applicable)
- Country of design registration
- Supporting evidence (links or files showing the registration for registered designs)
- Proof of original design creation (for unregistered designs)
Once you've entered the required details, click NEXT.
7. Enter Your Contact Information
- Provide your full name, company (if applicable), email, mailing address, and phone number.
- If you are filing on behalf of a rights holder, include their name and contact details.
- Click SUBMIT.
8. Sign & Confirm Your Submission
- A signature box will appear. Enter your signature and check the box confirming that all submitted information is accurate.
- Click CONFIRM to finalize your submission.
- A confirmation page will appear, and you will receive an email notification regarding the status of your complaint.

FLONIFY Marketplace Policy: Anti-Counterfeiting & Intellectual Property Protection

At FLONIFY, we prioritize customer trust and strive to offer a genuine, high-quality shopping experience. To uphold this commitment, all products sold on the FLONIFY Marketplace must be authentic. The sale of counterfeit, infringing, or unauthorized products is strictly prohibited. Failure to comply with this policy may result in account suspension or termination, removal of listings, loss of payments, and confiscation of inventory if found to be in violation.
1. Seller Responsibility
All FLONIFY Marketplace sellers are responsible for sourcing, selling, and fulfilling only genuine, legally obtainedproducts. The following are strictly prohibited:
- Counterfeit goods, including bootlegs, replicas, and unauthorized reproductions.
- Pirated copies of any products, including media, software, and branded merchandise.
- Illegally manufactured products that violate copyright, trademark, patent, or design rights.
- Unauthorized use of trademarks, logos, or branding without explicit permission.
If FLONIFY suspects a seller of fraudulent activity, including selling inauthentic goods, we may pause remittance payments and conduct an investigation.
2. Enforcement & Legal Action
FLONIFY collaborates with intellectual property rightsholders, enforcement agencies, and legal authorities to detect and prevent fraudulent or infringing products from being sold on the platform. We reserve the right to:
- Remove suspicious listings at our discretion.
- Suspend or terminate seller accounts engaged in counterfeit sales.
- Support legal action against sellers or suppliers knowingly violating this policy.
Violators may face civil and criminal penalties, including:
- Fines and imprisonment for counterfeit-related crimes.
- Loss of any revenue earned from the sale of inauthentic goods.
- Statutory damages and reimbursement for harm caused to rightsholders.
- Legal fees and attorney costs for IP infringement cases.
3. Seller Agreement & Compliance
By selling on the FLONIFY Marketplace, you acknowledge and agree that:
- Selling counterfeit or infringing products is strictly prohibited.
- You must not sell any illegally produced or unauthorized branded products.
- FLONIFY may request verification documents proving the authenticity of your products.
Sellers who fail to provide the necessary documentation may have their listings removed, accounts restricted, and payments withheld.
